Section 59 Warnings
The police can issue you with a S59 for almost anything while you are in charge of your car.
They can issue you with one for making excessive noise for instance.
This could even be playing loud music or revving your engine unnecessarily.
If they suspect that you have been speeding or using your car in a manner likely to cause distress or alarm to anyone they can issue you with a Section 59 warning.
They can also take away your car and you have to pay £150.00 to get it back and £20.00 for every day they have it.
If they give you a Section 59 warning, this stays on the police databases for 12 months.
If you get stopped again within that time for anything they suspect you of doing wrong, they will take your car off you.
So in all likelihood when you are in front of a police car with an ANPR your car will flag up and they will probably stop you to have a chat
Remember they only have to "suspect" you of doing something or have "reasonable grounds" you contravened the Road Traffic Act (Section 3 or 34).
If they have no proof of your "wrongdoing" they will give you a S59 "warning".
I am posting this because my friend has been given a warning for suspected speeding.
He was driving at 3am and nobody was about except a speeding police car behind him in order to catch up.
My friend insists he was not going over the 30 MPH limit and wasn't driving inconsiderately either.
He feels that the police had nothing better to do on the night!
Is this what the police have come to?
They can take a dislike to you and give you their stupid warnings knowing that within 12 months they can do the dirty on you.
The problem is that there is no right to appeal against the Section 59's so you can't challenge them!
